Terms of Service

1. Acceptance of terms

By accessing or using the DataMetrixx platform (hereinafter, “the Service”), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use the Service. Continued use of the platform constitutes acceptance of these terms and of any future amendments.

2. Description of the service

DataMetrixx is a SaaS (Software as a Service) platform designed for managing, processing and visualizing data. The Service allows users to upload datasets, build interactive dashboards, generate visual reports and publish custom pages with embedded information for their clients or teams.

DataMetrixx reserves the right to modify, update or discontinue features of the Service at any time, giving users prior notice when such changes significantly affect their experience.

3. Registration and accounts

To use the Service, you must create an account by providing accurate, complete and up-to-date information. You are solely responsible for keeping your password confidential and for all activities that occur under your account.

• You must provide real and verifiable information when registering.
• You are responsible for keeping your password secure and not sharing it with third parties.
• You must immediately report any unauthorized use of your account.
• You may not create accounts using false identities or on behalf of another person without authorization.

4. Trial period

DataMetrixx offers a free 7-day trial with full access to all platform features. No payment commitment or credit card details are required during this period.

At the end of the trial period, users may choose a subscription plan to continue using the Service. If no plan is purchased, access to the platform will be limited until the corresponding subscription is in place.

5. Plans and payments

The Service operates on a monthly subscription model. Prices are stated in Mexican pesos (MXN) and may include a one-time setup fee depending on the plan and the client's needs.

• Subscription payments are billed monthly in advance.
• The setup fee is charged only once, at the start of the business relationship.
• DataMetrixx reserves the right to change its prices with at least 30 days' prior notice.
• Failure to pay may result in temporary or permanent suspension of access to the Service.

6. Acceptable use

You agree to use the Service responsibly and in accordance with applicable law. The following are strictly prohibited:

• Using the platform for illegal or fraudulent activities.
• Scraping, data mining or otherwise automatically extracting information from the Service without authorization.
• Distributing malware, viruses or any other malicious code through the platform.
• Attempting to access other users' accounts, data or systems without authorization.
• Intentionally overloading the Service's infrastructure.
• Reselling or redistributing access to the Service without express authorization.

7. Intellectual property

All content, source code, design, trademarks and visual elements of the DataMetrixx platform are the property of Dixi Project and are protected by applicable intellectual property laws.

The data, documents and content that users upload or generate through the platform are and will remain the exclusive property of the user. DataMetrixx claims no ownership rights over user content and will process it solely to provide the contracted Service.

8. Data privacy

The collection, use and protection of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms of Service. We encourage you to read it carefully to understand how we handle your information.

9. Limitation of liability

DataMetrixx provides the Service “as is” and “as available”. To the fullest extent permitted by law, DataMetrixx and its officers, employees and partners shall not be liable for:

• Indirect, incidental, special or consequential damages arising from the use of the Service.
• Loss of data, revenue or profits related to the use of, or inability to use, the Service.
• Service interruptions caused by factors beyond our reasonable control.

DataMetrixx's total liability shall not exceed the amount paid by the user during the 12 months preceding the event giving rise to the claim.

10. Termination

DataMetrixx reserves the right to suspend or cancel accounts that violate these Terms of Service, without prior notice in cases of serious breaches. In less critical situations, the user will be notified and given a reasonable period to correct the conduct.

Users may cancel their account at any time from their profile settings. After cancellation, the user's data will be retained for 30 days, after which it will be permanently deleted.

11. Changes to the terms

DataMetrixx may amend these Terms of Service at any time. Significant changes will be communicated to users through the platform or by email at least 15 days in advance. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.
